The evil call “right to happiness”
The purpose of this article is to conduct a conceptual analysis of the term happiness from both philosophical and legal perspectives, and to examine whether it could be regarded as a right subject to some form of state protection. The notion of happiness has been incorporated, since the eighteenth century, into various international instruments that played a pioneering role in the establishment of human rights, and it is currently enshrined in the constitutions of certain countries. Happiness is a subjective concept, as it represents an individual feeling that arises from a person’s experiences, circumstances, and the fulfillment of their desires. In this sense, everyone is solely responsible for managing their own happiness according to their personal understanding of it, making it utopian to claim that the State can guarantee happiness for all. Nevertheless, the State can provide and safeguard a set of conditions and goods that enable each person to self-manage their own happiness.
