Civil liability in family law reparations for abandonment, divorce, and domestic violence
The family is an institution that protects and restores rights; its formation through natural or legal ties (Colombia, National Constituent Assembly, 1991) entails the assumption of specific duties and obligations. Stemming from these obligations, there is currently significant interest in the issue of damages caused by conduct that violates the duties and rights associated with family relationships. This article analyzes—from a legal perspective—whether claims for pecuniary and non-pecuniary reparation can be made in cases of abandonment, divorce, and domestic violence. It examines how the breach of family duties and obligations—particularly those regarding care, solidarity, and cohabitation—generates harm that requires recognition and reparation, beyond any criminal or judicial sanctions. Likewise, the study explores the jurisprudential and doctrinal developments that have enabled the recognition of moral, psychological, and economic damages suffered by spouses, children, and other family members, as well as the tensions between protecting the family as an institution and the principle of full reparation for victims. Finally, the article outlines the challenges involved in establishing a clear line of case law that harmonizes private autonomy with the best interests of children and adolescents.
