Obstacles preventing the implementation of Alternative Justice in Mexico A realistic and effective approximation for its simplification
In recent years, the administration of justice in Mexico has been in a state of crisis, which has prevented it from advancing as a benchmark model that embodies the true essence of justice that is accessible to the people. This has created mistrust among those who appear before these judicial institutions, resulting in repercussions in other areas related to justice. Hence the need to integrate new systems, models, instruments, and institutions that allow conflicts to be resolved quickly and easily accessible to the public.
In view of this crisis and the lack of improvement and implementation of new methods that bring citizens closer and involve them in the real and effective solution of their own problems, new laws are being enacted at the national level on the implementation of dispute resolution methods applicable in various branches of law, but these have not been sufficient as they have not achieved the expected results.
The objective is to demonstrate whether the lack of economic and human capital in the judiciary and the involvement of other professionals, difficult access, resistance to change among lawyers faced with these new avenues for administering justice, and the lack of awareness of conflict resolution methods are barriers that prevent alternative justice from being administered.
This article is based on a mixed model, using a deductive method with a qualitative approach through the analysis of regulations, doctrinal documents, and literature, and a questionnaire for quantitative analysis, concluding that it is necessary to standardize the legislation regulating the practice of lawyers, integrate content into institutional curricula, allocate more budget to generate awareness campaigns, and hire more staff to counteract the problem.
