The democratic dimension of administrative law and its connection to the principle of progressive realization of human rights
Many authors have argued that the recognition of human rights within national and international legal frameworks has gradually led to the disappearance of the distinction between public and private law, giving rise to a unitary conception of law. However, for some theorists, this premise is not entirely accurate, as public and private law should instead be understood as instruments aimed at ensuring the protection and realization of human rights. This perspective prevents the materialization of the purported unification of law.
By extension, administrative law also assumes an instrumental role in the realization of human rights, requiring public administration to take these rights seriously. This obligation constitutes one of the practical manifestations of the democratic dimension of law, particularly in relation to the promotion, observance, and respect of human rights. Furthermore, alongside this dimension, the principle of the progressive realization of human rights must also be considered, insofar as public administration is required to continuously assess both the progress achieved and the outcomes of the measures adopted to guarantee the effective enjoyment of recognized rights.
