Prospects for the application of AI in MASCS challenges and opportunities for the human right to justice
Artificial Intelligence is a technological advance that invites social transformation, as is the case with its use in the field of the human right to justice through ADR in Colombia and Mexico, countries where the institutions responsible for justice are adapting to these new realities that contribute to overcoming barriers that limit access to this right. The objective of this paper is to analyze the challenges and opportunities arising from the use of Artificial Intelligence in the context of the human right to justice through the use of Alternative Dispute Resolution Mechanisms. This study will focus on Mexico and Colombia, using a qualitative study with the help of documentary sources of information, within the field of socio-legal research and comparative law. It concludes that the use of AI within ADR still has a long way to go, with the creation of adequate platforms, challenges and opportunities yet to be identified. It also requires commitment from the government to ensure greater connectivity, as well as the applicability of legislation and public policies on artificial intelligence within ADR. Most importantly, social and legal adaptation is needed.
