The right to be forgotten versus the comprehensive protection of the rights of children and adolescents in Mexico

The objective of this investigation is to analyze the collision that exists between the right to be forgotten of people who served a sentence for the commission of criminal conduct of a sexual nature and the comprehensive protection of the rights of children and adolescents, in particular the prohibition that is imposed on them to work in environments in which they live directly and habitually with this group in a situation of vulnerability through a restriction on the right to be forgotten, supported by the purpose of guaranteeing non-repetition in victims and prevention of crime towards potential victims based on the best interests of children and adolescents. The above is done considering the parameters that this restriction must meet in accordance with the proportionality test.
