    O contributo das comunidades de energia sob forma cooperativa para o combate à pobreza energética.

    O presente artigo analisa o potencial das comunidades de energia constituídas sob forma cooperativa como instrumento de combate à pobreza energética. A revisão da literatura realizada demonstra que, embora a legislação portuguesa não imponha uma forma jurídica específica para estas comunidades, o modelo cooperativo revela-se particularmente adequado para enfrentar este problema social. Tal decorre da convergência entre o regime jurídico das comunidades de energia — sejam comunidades de energia renovável ou comunidades de cidadãos para a energia — e os princípios cooperativos, que assentam na adesão livre, no controlo democrático e na prossecução do interesse coletivo. Este estudo demonstra que, ao privilegiar benefícios ambientais, económicos e sociais em detrimento do lucro financeiro, as cooperativas oferecem um modelo de governação e de partilha de valor capaz de reduzir desigualdades no acesso à energia, promovendo maior justiça energética, contribuindo, de forma sustentável, para a mitigação da pobreza energética.

    Abstract

    This article examines the potential of energy communities established in cooperative form as an instrument to combat energy poverty. The literature review conducted shows that, although Portuguese legislation does not impose a specific legal form for these communities, the cooperative model proves particularly suitable for addressing this social problem. This results from the convergence between the legal framework of energy communities — whether renewable energy communities or citizen energy communities — and the cooperative principles, which are based on voluntary membership, democratic control, and the pursuit of collective interest. This study demonstrates that, by prioritizing environmental, economic, and social benefits over financial profit, cooperatives offer a governance and value-sharing model capable of reducing inequalities in access to energy, fostering greater energy justice and contributing, sustainably, to the mitigation of energy poverty.
