Derecho humano al agua y al saneamiento
una mirada crítica al cumplimiento de los Objetivos de Desarrollo Sustentable
El derecho humano al agua y al saneamiento, reconocido por la ONU desde el 2010, enfrenta en México profundas contradicciones entre su proclamación normativa y su garantía efectiva. Aunque está consagrado en el artículo 4.º constitucional y en tratados internacionales, la realidad muestra desigualdades estructurales en el acceso, principalmente en comunidades rurales, indígenas y periferias urbanas. Esta brecha revela una gestión hídrica subordinada a intereses económicos y marcada por un modelo tecnocrático y extractivista. La falta de infraestructura, el deterioro de fuentes hídricas y la privatización del recurso agravan una crisis que trasciende lo ambiental y se convierte en una vulneración sistemática de derechos humanos. Desde una perspectiva jurídica crítica, el agua debe ser entendida no solo como un recurso natural, sino como un bien común, cuya gestión democrática y sostenible es condición para la justicia socioambiental. Este artículo examina las tensiones entre el marco legal y las realidades territoriales que impiden el goce pleno de este derecho.
